Rules

BUSINESS RELATIONSHIP CONDITIONS BETWEEEN THE SHIPPING CLUB MANAGEMENT AND EACH OF ITS MEMBERS

ACCEPTANCE: 

Each company is required to fill out the ‘Join the Club’ form. 
After a thorough evaluation, the membership request will be either accepted or declined by the Club Management via email. The Management is not obligated to provide reasons for its final decision. 

All membership fees must be paid within 14 days of the invoice date and are non-refundable, even in cases of early termination or withdrawal. Members are responsible for their own bank charges, which are separate from the Annual Membership Fee and cover a 12-month membership period. Membership approval is only granted after the full Annual Membership Fee has been received. 

Payment of the fee confirms that each Member has agreed to the enclosed Terms & Conditions, Protection Plan terms, and Code of Ethics, specifically regarding bad debts and the implicit communication of this status to all The Shipping Club Members and to Forwarder Debt Recovery System. 
The Shipping Club Management’s decisions are final and cannot be questioned.

MAINTENANCE

The Member:

  • Represent only countries and cities where they have offices or operate. 
  • Do not advertise offices in countries or cities where they are not officially registered with The Shipping Club
  • Respect the privacy and confidentiality of all members’ interactions. • Pay close attention to all layouts required by clients and agents (members of the Network) regarding the shipment entrusted to them. 
  • Avoid any interactions or communications that discredit or insult any other member or the Network itself. 
  • Assist in the development of the Network. 
    Maintain all confidential and sensitive information regarding the Network and its members, especially the “Member List”. 
  • Encourage and offer new business opportunities to other Club members. 
  • Respond to quotation/information requests from fellow members within 24 hours. 
    Inform the Management immediately in case of lack of replies from fellow members. 
  • Accept and understand that any and all transactions between members are made subject to their own risk, and The Shipping Club is not held accountable or responsible in any way. 
  • Check the history of a member with the Management team before starting a collaboration, including membership status and further contacts. 
  • Consider it mandatory to inform The Shipping Club Management within 30 days from the expected payment date, and within a maximum of 60 days from the invoice date. 
  • Keep updated on any news regarding special shipments, company changes, and any relevant information through The Shipping Club portal. 
  • Contact The Shipping Club Management immediately regarding any company changes (contact details, change of company name/location, new branch, etc.). 
  • When submitting company news, photos, logos, or press releases to The Shipping Club management, members give The Shipping Club permission to use them.

MEMBERSHIP RENEWAL:

The membership is renewed automatically every year; however, The Shipping Club Management can decide not to renew a membership if the member does not follow The Shipping Club Rules and Code of Ethics.

 

CONFERENCES: 

The Shipping Club annual conferences are likely one of the most valuable advantages of being a member. These conferences allow our members to meet the Network management team and especially the existing members. This fosters strong bonds within the network. 

During the conferences, every member is required to be respectful of The Shipping Club staff and all members by participating in the conferences and being ready for business discussions and events. 

The Shipping Club staff will do everything they can, to select the place, arrange costs and help with travel VISA matters, to enable all members to join. 
Any member that fails to join the yearly conferences for two years in a row is subject to membership termination. Of course, all situations will be assessed individually and are at the discretion of The Shipping Club Management.

 

TERMINATION OF THE MEMBERSHIP: 

Cancellation of The Shipping Club membership may occur under the following circumstances: 

  • When a member submits a resignation notice to The Shipping Club Management. 
  • Non-compliance with The Shipping Club’s rules and regulations. 
  • Failure to meet satisfactory service standards. 
    Violation of the internal The Shipping Club Code of Ethics. 
  • Non-payment of annual fees as per established terms. 
  • Lack of prompt response to The Shipping Club Management regarding accounting and/or operational matters. 
  • Assuming a leadership position or ownership in a network directly competing with The Shipping Club by any principal of a Company Member. 

Every member has the freedom to leave The Shipping Club at their discretion. All fees paid are non-refundable. Notification of the withdrawal will be provided to all other members, and the former member has strictly prohibited from further utilizing any of The Shipping Club information in any format.

RULES OF LAW AND JURISDICTION: 

  • The services provided by The Shipping Club, the rules of The Shipping Club membership, the utilization of the website, and any other services rendered by The Shipping Club, are all subject to the laws of Spain.
  • By becoming a member, you are accepting the exclusive jurisdiction of Spanish Law and the geographical jurisdiction of the Court of Spain, with an explicit renunciation of any other jurisdiction and Governing Law. You unconditionally concur that the Spanish Law and Spanish Courts shall have sole authority to resolve any conflict that may emerge from, beneath, or in relation to the Membership Regulations, your usage of the website, and for any service provided by The Shipping Club.
